Patent Issues - Please help!?
I am interested in designing a new type of cloth diaper. I have researched it and there are already a TON of patents out there.
My questions are:
1. The patents seem to overlap or violate eachother. How can that be?
2. There are some patents that were made on products that did have prior art - how can they get a patent if there is prior art?
3. Several of the patents state at the end that they include any variation of ... how can they do that?
4. If I design a cloth diaper that has features I've never seen before in one design - would that keep me from violating the patents?
What is the statute of limitations on a patent and when does it become public property?
It seems like people in this industry are really taking advantage of the patent law - which doesn't seem to be legal or fair. Some of the designs patented are so obvious and have been used for decades. It's like patenting a table cloth and not letting anyone else make or sell one!

A patent is a set of exclusive rights granted by a state to an inventor or his assignee for a fixed period of time in exchange for a disclosure of an invention.
